1. ABOUT SIGNSENDERS
SignSenders ("we," "us," "our," "the Platform") is a technology platform that enables freelancers to create, send, and manage contracts with their clients, using OTP-based electronic signature verification and WebAuthn hardware biometric attestation.
2. PLATFORM, NOT PARTY TO CONTRACTS
SignSenders is a technology platform that enables freelancers to create, send, and manage contracts. We are NOT a party to any contract created, sent, or signed through this platform. We do not guarantee, endorse, or take responsibility for:
- Payment between freelancer and client
- Fulfillment of contract terms by either party
- Disputes arising from the contract's content or execution
- The accuracy or legality of any contract content created by users
Users are solely responsible for the terms they include in their contracts and for enforcing or resolving any disputes independently, or through appropriate legal channels.
3. NO INVOLVEMENT IN CLIENT PAYMENTS
SignSenders charges users only for use of its contract creation and e-signature platform (via Contract Credits). SignSenders does not process, hold, or have any involvement in payments made between freelancers and their clients. Any financial transactions between freelancer and client occur outside of SignSenders and are the sole responsibility of the parties involved.
4. ELECTRONIC SIGNATURE METHOD & LEGAL VALIDITY
4.1 HOW IT WORKS
SignSenders uses an out-of-band OTP verification method:
- The contract link is sent to the client via email
- The freelancer shares a unique 6-digit OTP directly with the client through an independent channel (WhatsApp, phone call, SMS, etc.)
- The client enters the OTP to access the contract review session
- The client performs biometric authentication (Face ID, Touch ID, or Windows Hello)
- A certified signed PDF is generated with an audit trail containing: signer's name, email, IP address, timestamp, OTP verification status, WebAuthn assertion data, and a SHA-256 tamper-evident hash seal
4.2 TYPE OF SIGNATURE
SignSenders provides a Basic Electronic Signature under the Information Technology Act, 2000 (India). It is NOT:
- An Aadhaar-based e-Sign (which requires UIDAI integration)
- A Digital Signature Certificate (DSC, Class 3)
- A notarized signature
4.3 LEGAL RECOGNITION
Electronic contracts formed through electronic signatures are recognized under Section 10A of the Information Technology Act, 2000 and Section 65B of the Indian Evidence Act, 1872 (now Section 63 of Bharatiya Sakshya Adhiniyam, 2023). Contracts formed on SignSenders are valid agreements under the Indian Contract Act, 1872, provided essential elements of a contract are met (offer, acceptance, lawful consideration, capacity, free consent).
